How to report copyright-infringing material hosted on Citruxhosting infrastructure.
DMCA COPYRIGHT POLICY
Citrux Hosting ("Company," "we," "us," or "our") provides digital infrastructure and hosting services. We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, we have adopted the following policy toward copyright infringement.
1. DEFINITIONS
- "User Content" means any data, files, software, or material uploaded, stored, or transmitted through Citrux Hosting services.
- "Service" refers to all hosting, infrastructure, network, and related offerings provided by Citrux Hosting.
2. NOTICE OF INFRINGEMENT
Citrux Hosting does not monitor user content and cannot determine whether material posted by users infringes upon third-party rights. We act only upon receiving valid DMCA notices. If you believe that any content hosted on our servers infringes upon your copyrights, you may submit a notification to our Designated Agent with the following information in writing:
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the infringing material and information reasonably sufficient to permit us to locate the material (e.g., the specific Server ID, IP address, or directory path).
- Your contact information, including your address, telephone number, and an email address.
- A statement of good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement under penalty of perjury that the information in the notification is accurate and that you are authorized to act on behalf of the owner.
- A physical or electronic signature of a person authorized to act on behalf of the owner.
Note: Citrux Hosting may request additional information if the notice is incomplete or insufficient to identify the allegedly infringing material. Submitting false or misleading DMCA notices may result in account termination and potential legal consequences.

4. TAKEDOWN AND NOTIFICATION
Upon receipt of a valid, compliant DMCA notice, Citrux Hosting will:
- Expeditiously remove or disable access to the allegedly infringing material.
- Promptly notify the affected user that access to the material has been disabled.
- Notice Forwarding: A copy of the notice (which may include the complainant's contact information) will be forwarded to the user who uploaded the material.
- Transparency: We may publish redacted versions of DMCA notices or counter-notices to comply with transparency requirements.
5. COUNTER-NOTIFICATION & RESTORATION
If a user believes that their material was removed by mistake or misidentification, they may file a counter-notification with our Designated Agent. To be effective, the counter-notification must be a written communication that includes:
- Identification of the material that has been removed.
- A statement under penalty of perjury that the user has a good faith belief that the material was removed as a result of mistake or misidentification.
- The user's name, address, and telephone number.
- A statement of consent to the jurisdiction of the Federal District Court for the judicial district in which the user's address is located (or Dallas County, TX if the address is outside the U.S.).
- A physical or electronic signature.
Content Restoration: If a valid counter-notification is received, Citrux Hosting may restore the material within 10–14 business days unless the original complainant notifies us that they have filed a court action to restrain the user.
6. REPEAT INFRINGER POLICY
Citrux Hosting maintains a "Repeat Infringer" policy. We will terminate, in appropriate circumstances, the accounts of users who are found to be repeat infringers. We reserve the right to terminate any account immediately for a single, egregious instance of infringement at our sole discretion.
7. NON-U.S. COPYRIGHT COMPLAINTS
For copyright complaints arising outside the United States, Citrux Hosting will follow applicable local laws and may use the DMCA process as a baseline procedure for addressing infringement claims.
